We are writing to you about your discrimination claim that your dad brought to the tribunal. Your dad thought that your 2 exclusions from school in 2023 were unfair.
We are the three members of the tribunal. Our job is to listen to everyone’s point of view and then make a decision based on what the law says. We don’t work for the school or anyone else. We make up our own minds.
Thank you for speaking to us and allowing your advocate’s report. We listened carefully and it was a great help to us to hear your views.
We know it has taken a long time for all the meetings to happen. The two exclusions from school must seem like a long time ago but it was important that we took the time to hear everyone’s point of view and for us to check all the information we had.
Our tribunal decision is that the school had good reasons for its decisions to exclude you in 2023. The school has to keep everyone feeling safe both physically and mentally. The school excluded you to keep you and other pupils and teachers safe. That was fair because there was nothing else they could reasonably have done at that time to keep everyone safe.
Nobody thinks that you did anything unsafe on purpose. Sometimes we can all do things that seem OK to us at the time but can make other people feel unsafe. We also know that young people with ADHD can act before thinking.
The exclusions gave the school time to think about what would support you better, and they gave you and your family time to reset so that things would be better in the future. We heard that your family is very supportive and your dad especially helps you a lot.
We know that things have changed for the better since 2023. The school is trying to support you in different ways. The school told us that you are doing really well. They said that you have been working hard and have done well in getting qualifications. We are very happy to hear of your qualification successes and that school is going better for you.
We know that young people with ADHD often say they cope better with things as they get older. It can get easier to learn new skills, find new ways to cope, and ask for support or help when they need it. You told us that things are very different for you in school now. We hope you will find that things get easier as you get older and that you will keep on doing well at school and enjoying it more.
